A commercial court in occupied Luhansk Oblast has issued a binding verdict requiring the Russian state to compensate a Ukrainian firm for agricultural stock lost during the invasion. The ruling, handed down by the Commercial Court of Luhansk Oblast, orders Russia to pay 65.36 million hryvnia, a sum equivalent to approximately 1.6 million US dollars. This payment is designated for Oliiar, a private enterprise that lost a significant portion of its sunflower seed inventory when its storage facilities in Svatove were taken over by occupying forces.
The legal dispute traces its origins to October 2021, prior to the full-scale invasion. At that time, Oliiar entered into a contract to purchase 4,700 tonnes of sunflower seeds from the 2021 harvest. The seller in this transaction was Prydniprovske Agrarian Company LLC. To manage the logistics of the purchase, Oliiar arranged for a separate entity, Svatove-Ahro LLC, to handle the storage of the crop.
The supplier fulfilled its delivery obligations by sending the entire consignment to a warehouse in Svatove operated by Svatove-Ahro. By the eve of the invasion, on 24 February 2022, the storage facility had successfully transferred 2,592 tonnes of the seeds to Oliiar. This left a remaining balance of 2,107 tonnes still held in the warehouse at the moment the conflict escalated.
Following the start of the full-scale war, Russian armed groups seized control of the warehouse premises. The remaining seeds, which constituted a substantial part of Oliiar's purchase, were held within these occupied facilities. The company never recovered that portion of the crop, resulting in a direct financial loss that formed the basis of the lawsuit.
In its decision, the court accepted the evidence presented by Oliiar as conclusive. The judges determined that the loss of the agricultural product was a direct consequence of Russia's armed aggression. Consequently, the court ordered the Russian Ministry of Justice, acting as the representative of the Russian state, to disburse the compensation. The specific amount of 65.36 million hryvnia was calculated based on an expert valuation of the lost goods.
Oliiar is a company registered in Pustomyty, a town in the Lviv Oblast of western Ukraine. The firm is led by Iryna Podoba, who serves as the director, and was founded by Iryna Zalizna. The ruling marks a significant step in the legal recognition of private sector losses incurred during the occupation of Ukrainian territories.
This verdict is not an isolated incident within the same jurisdiction. The Commercial Court of Luhansk Oblast has previously issued a similar decision in a related case. In that earlier ruling, the court ordered Russia to pay 51.67 million hryvnia, approximately 1.25 million US dollars, to Trading House Agrokhim LLC. That compensation was for property lost in both Svatove in Luhansk Oblast and Kakhovka in Kherson Oblast.
The series of rulings highlights the growing body of legal precedent in which Ukrainian courts are holding the Russian state financially liable for assets seized in occupied regions. These decisions provide a mechanism for private businesses to claim damages directly against the occupying power, offering a pathway for restitution even as the conflict continues.
