FBI Veterans Accused of Congressional Perjury

Former intelligence leaders face prison sentences for allegedly concealing their roles in the Hunter Biden laptop investigation.

The Justice Department has formally accused two former senior FBI officials of lying to Congress regarding the bureau's handling of high-profile investigations.

The charges, announced on Friday, target Nikki Floris and Bradley Benavides. Floris previously led the intelligence division in the FBI's Washington field office, while Benavides served as a deputy assistant director for counterintelligence. Prosecutors allege that both women and men intentionally concealed their involvement in probes related to Hunter Biden, the son of former president Joe Biden. If found guilty, each defendant faces a potential prison sentence of up to five years. Following a brief appearance before a federal magistrate judge, both were released on Friday morning.

The prosecution is being led by US Attorney Jeanine Pirro. In a statement, she argued that the pair undermined the institutions they vowed to protect. She characterized the act of lying to Congress as a strike at the core of the democratic system. Pirro suggested that when senior agents believe they are above the law, decisive legal action is required. Her office described the behavior as a failure of accountability among those tasked with upholding it.

An FBI affidavit details specific discrepancies between the testimony and the alleged internal communications. It claims Floris denied any involvement in the Hunter Biden investigations during her 2023 testimony before the House Judiciary Committee. The document states she was actually in frequent contact with the case team for over a year. It also alleges she claimed ignorance about the laptop when she had coordinated the FBI's real-time response to media reports about it. Benavides testified a few months later, stating he learned about the laptop from a Wikipedia entry. The affidavit counters this by asserting he was in constant communication about the device for several days.

Defense attorneys have vigorously contested the allegations. Lawyers for Floris argued the accusations rely on political claims rather than factual evidence. They described her as a patriot who served as an intelligence officer for nearly two decades. They noted the timing of the charges as significant, filing them years after the testimony and on the eve of an election. Ron Safer, representing Benavides, asked the court to review whether prosecutors had sufficient evidence against what he called two lifetime public servants.

US Magistrate Judge Zia M. Faruqui has raised questions about the materiality of the alleged lies and the age of the case. He granted the defense's request for a hearing to evaluate the government's evidence, setting it for Tuesday. This timeline is unusually swift for defendants who have been released. Faruqui acknowledged the rarity of such a quick schedule, noting that the charges stem from testimony given more than three years prior. He observed that both defendants have strong law enforcement backgrounds and a clear interest in resolving the matter quickly to clear their names. He described the situation as a hanging sword over their heads, a burden that would persist for the rest of their lives.

The case centers on a laptop that has become a major partisan symbol in American politics. Republicans argue it contains evidence of corruption within the Biden family. Democrats counter that it is part of a broader Republican conspiracy. The device was handed to the FBI in 2019 after a computer shop owner reported that Hunter Biden left it behind. The owner stated he turned it over to authorities after viewing some of its contents. This legal battle occurs against a backdrop of significant personnel changes within the FBI since the start of President Donald Trump's second term. Many agents accused by Trump allies of working against him have been pushed out, with some citing their involvement in Trump-related investigations as the reason for their dismissal.
